Mollie Werwas, and Sean Hurley recently prevailed in their Summary Judgment Motions for the firm’s client, 1480 Lake Street, LLC, in the matter of Jessica Hartner v. 1480 Lake St., LLC, et al. in DuPage County. The Court agreed that 1480 Lake Street, LLC, was immune from liability for an incident occurring on property leased to a separate tenant defendant, by virtue of its lease with that entity. The holding is significant for the firm and for future cases where property owners are sued for injuries that occur on leased property, as the Court upheld the concept of landlord immunity for third party claims on property leased to a tenant and no longer within the landlord’s control.
