On September 27, Mollie Werwas and Jeanne Zeiger spoke at the Annual Conference for the National Forum for Environmental & Toxic Tort Issues (FETTI). Mollie and Jeanne’s presentation, entitled “Who’s in Charge: Controlling the Defense, RORs, and Declaratory Actions,” focused on issues that arise between insurers and policy holders when defending litigation that involves coverage disputes or conflicts. The topics addressed included how carriers and policy holders manage the conflicting interests that can often arise in litigation, including when a policy holder has a right to select independent counsel, identifying actual conflicts giving rise to such rights, and managing control of the defense throughout the stages of litigation. Finally, Mollie and Jeanne addressed the rights of the insurer and the insured during settlement negotiations, including the insurer’s duty to settle and options if an insured is withholding consent to a settlement.
